A central principle of the transition to democracy in Libya is that justice and security institutions need to be both responsive and representative to be effective and enjoy public confidence and trust. In the current situation, the rule of law system has many shortcomings: it is characterized by a continuing crisis over the legitimacy of executive and legislative institutions, fragmentation of authority and continued divisions among political and security actors.

Access to justice and rule of law situation for people living in Libya could and should improve and people should have access to justice and security services that effectively respond to their needs and protect and uphold their rights. In 2022, UNDP invested in exploring opportunities, learning from previous interventions, and identifying new potential partners in Libya.

In 2023, UNDP Libya adopted a new project – Strengthening the rule of law and Justice in Libya. Through this project, UNDP is supporting national authorities and civil society organizations in the area of the rule of law with a focus on:

• Responsive, and responsible institutions ensure transparent, gender responsive, effective, and efficient justice systems to address people’s justice needs all over Libya. 
• Community oriented access to justice and security is enhanced in key jurisdictions, particularly for women and children and at-risk and vulnerable groups processes.
• An environment conducive to peaceful resolution of conflicts, is progressively expanded through working with CSOs, youth and women networks.

 

The National Justice Analyst will support the Rule of Law project team and will implement the duties and responsibilities described in this Job description. 

The position will be based in Tripoli, Libya.

 

 

The National Justice Analyst is expected to work independently, with minimal supervision but in close collaboration with the Project Team in Libya, and to actively engage with government and civil society partners and other actors. The successful candidate will have the following specific responsibilities:

 

Ensuring/Supporting the project Team in the implementation of the ‘Strengthening the Rule of Law and Justice’ Project based on national legal framework and best practices on rule of law and access to justice.

 

• Support the Project Manager in the implementation, planning, and M&E of the Rule of Law and Justice Project and related activities,
• Accompany and support in a close manner (according to the methodology determined) the project’s activities with the institutions targeted by the programme (Attorney General Office, Ministry of Justice, Universities, Bar associations),
• Conceptualize and provide technical and organizational support for the project’s activities, including through the drafting of concept notes and terms of reference as well as the development of the project Annual Work Plan,
• Ensure financial monitoring of the use of funds in strict and consistent application of UNDP rules and regulations in close collaboration with Operations and Financial Services,
• Conduct thorough analysis and research of the political, legal, and governance situation in Libya on a continuous basis with a particular focus of areas that have impacts on the project implementation,
• Keep abreast of policy and legal changes that can affect project implementation,
• Review concept notes, reports, and ToRs for all project activities based on prior needs assessment and context analysis as well as international standards and UN Guidance,
• Conduct regular field monitoring visits, reporting back on findings and recommendations, follow-up to ensure timely implementation of the recommendations to build the capacity of the implementing partners and respect of Do-No-Harm policies,
• Ensure adherence of project activities to UN human rights Do-No-Harm policy, inclusion, transparency and due diligence policies, and providing risk mitigation measures where necessary,
• Support, in his/her areas of competence, the work of the various international/national consultants working within the framework of the Project,
• Perform other activities/tasks as assigned by the Project Manager and the Governance and Rule of Law Team Leader.

 

Building and maintaining trusted relations with key partners, including judicial actors and civil society organizations, in all regions and target areas of the Project, including to oversee grants’ implementation.

 

• Develop and  maintain strong working relationships with the national side, both at the central and local levels, with a view to building comprehensive and sustainable partnerships, including serving as an interface for the reporting and communication of essential information in the context of project implementation,
• Support consultations with national stakeholders for the implementation of all project activities, including with the project’s technical committee, civil society organizations and local actors,
• Contribute to strengthening synergies and modes of collaboration with the central services of the Ministry of Justice and its different entities, the Judicial Police and penitentiary establishments, the Attorney General Office, the Supreme Judicial Council, judicial institutions and the judicial police, Bar Association, University Law Schools,
• Assess capacity-building needs among local partners, including civil society organizations and victims’ groups, and help develop well-structured and sustainable plans for addressing them, 
• Build strong and trusted relationship with local counterparts, as well as with target communities,
• Identify appropriate civil society partners and monitor implementation of grants and other contractual engagement, in coordination with Project Team,
• Actively participate in and promote UNDP`s position at technical meetings on justice and Rule of Law,
• Interact with other UN experts on Rule of Law, Corrections and Justice Reform issues in order to strengthen the involvement of the UN and its assistance to the Government and other institutions of the country in the justice reform process.

 

Facilitation of knowledge building, effective communication, awareness raising of the project activities and building partnerships.

 

• Substantially support capacity-building initiatives of national partners, including through the development of training curricula, the organization of training workshops, conferences and seminars, the design of interventions, as well as the identification of opportunities for sharing experiences with other countries, particularly in the context of South-South cooperation,
• Contribute to the production of the necessary progress reports (quarterly, semi-annually and annually), distilling lessons learnt, 
• Provide sound contribution to knowledge building, networks and communities of practice, 
• Ensure systematic recording of best practices and lessons learnt from project implementation in the area of Justice, Corrections and Rule of Law,
• Provide technical support to Rule of Law project manager and implementing team to analyze results and lessons learnt and best practices in project implementation and participate actively in relevant communities of practice,
• Contribute to project communications and visibility efforts including the development of a range of core communication content including reports, briefings, infographics, case studies and presentations,
• Explore and develop new intervention opportunities and strategic partnerships in justice sector reform.

The incumbent performs other duties within their functional profile as deemed necessary for the efficient functioning of the Office and the Organization.

Institutional Arrangement

The National Justice Analyst will work under the direct supervision of the UNDP Rule of Law Project Manager. He/She will be managed by UNDP and is bound by all UNDP Human Resources policies. He/She must adhere to all ongoing UNDP corporate rules and regulations, including SOPs and internal procedure policies applicable to UNDP Libya personnel working within the country office.

Min. Education requirements	Advanced university degree (master`s degree or equivalent) in Law, Human Rights, Public Policy, Political Science, or related disciplines is required, OR A first-level university degree (bachelor’s degree) in the above mentioned field in combination with an additional two years of qualifying experience will be given due consideration in lieu of advanced university degree.
Min. years of relevant work experience	Minimum 2 years (with master’s degree) or 4 years (with bachelor’s degree) of relevant experience at the national or international level on rule of law, legal or judicial system, protection and advocacy of human rights, and/or corrections, At least one demonstrable experience in project delivery in cooperation with governments in the field of Governance, Rule of Law, justice and/or security within the last three years.
